Terms of Service

1. Acceptance of Terms

By creating an account, purchasing a subscription, or using the SunshineStats Pro service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

SunshineStats Pro provides a data platform for Florida political professionals, offering access to consolidated voter statistics, election results, census data, and related information. The data and features available are determined by your chosen subscription plan.

3. User Accounts

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. The primary user who creates the account is designated as the "Account Admin" and is responsible for managing all user seats associated with that account. You agree not to share user logins with individuals beyond the number of seats permitted by your subscription plan.

4. Subscriptions, Billing, and Payments

4.1. Subscription Plans: The Service is offered through various subscription plans (e.g., Local, Regional, Statewide). Your access to data is determined by the plan you purchase.

4.2. Billing Cycles: Subscriptions are billed on a recurring basis, either monthly or annually, as selected at the time of purchase. Your subscription will automatically renew at the end of each billing cycle unless you cancel it.

4.3. Payment: You agree to provide a valid payment method and authorize us to charge it for your chosen subscription plan. All payments are processed through our third-party payment processor, Stripe.

4.4. No Refunds: All payments are non-refundable. There will be no refunds or credits for partially used periods, downgrades, or unused time.

5. Cancellation and Termination

5.1. Cancellation by You: You may cancel your subscription at any time through your account dashboard. If you cancel, your subscription will remain active until the end of your current paid billing period, and you will not be charged again. No partial or pro-rata refunds will be issued for the remaining time in the billing period.

5.2. Termination by Us: We reserve the right to suspend or terminate your account without notice if you breach these Terms, including but not limited to violating the Acceptable Use Policy.

6. Acceptable Use Policy

You agree not to:

  • Share your account credentials or user seats with unauthorized individuals.
  • Resell, redistribute, or systematically scrape data from the Service.
  • Use the Service for any illegal or unauthorized purpose.
  • Attempt to gain unauthorized access to our systems or engage in any activity that disrupts the Service.

7. Intellectual Property

The Service and its original content, features, functionality, and data compilations are and will remain the exclusive property of SunshineStats Pro and its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your professional purposes, subject to these Terms.

8. Disclaimers and Limitation of Liability

8.1. Service Provided "As Is": The Service and its data are provided on an "as is" and "as available" basis. While we strive for accuracy, we do not warrant that the data will be complete, accurate, or error-free. You agree that your use of the Service is at your sole risk.

8.2. Limitation of Liability: In no event shall SunshineStats Pro, its directors, or employees be liable for any indirect, incidental, or consequential damages arising out of your use of the Service. Our total liability to you for any and all claims shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by emailing the address associated with your account or by posting a notice on our website. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions.

11. Electronic Communications

                   

By creating an account, you consent to receive electronic communications from us. These communications may include notices about your account (e.g., billing, password changes), service-related information, and promotional messages about new features, app updates, and special offers. You agree that any notices, agreements, or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.
